The Ministry of Finance, the General Administration of Customs and the State Administration of Taxation jointly issued a notice on Monday to levy consumption tax on e-cigarettes. The announcement shows that electronic cigarettes will be included in the scope of consumption tax, and electronic cigarettes will be added under the tobacco tax. E-cigarettes are taxed on an AD valorem basis, with a tax rate of 36% for production (import) and 11% for wholesale. It will be implemented from November 1, 2022.


According to the analysis, the levy of consumption tax on e-cigarettes can be said to be an empty opportunity, which means that the expansion and profitability of the e-cigarette industry may be limited in the short term, but the e-cigarette industry will be further regulated in the long term.
