Recently, the federal government of Malaysia announced the "E-Cigarette Product Description (Certification and Labeling) Order 2022", which clarifies that starting from August 3, 2022, both domestically manufactured or imported e-cigarettes must apply for SIRIM certification. and markup.


According to the decree, the SIRIM certification mark should be affixed to the container of vaping equipment, its spare parts or other devices so that it can be easily seen by the user. The SIRIM certification mark indicates that the device complies with safety standards and can be used normally.


Any person or company that violates this Act will face financial or criminal penalties. Companies that break the law will be fined up to RM200,000. For repeat offenders, the fine can be as high as RM500,000. If convicted, individuals can also be fined up to RM100,000, jailed for up to three years, or both. Repeat offenders will be fined up to RM250,000, jailed for five years or less, or both.


A study by the Malaysian Vaping Chamber of Commerce (MVCC) revealed that the vaping industry in Malaysia is worth RM2.27 billion, and the vaping industry has become a booming industry in Malaysia, accounting for a 42% share of the overall tobacco market – more than illicit cigarettes (share 37%) and legal cigarettes (21% share). The Malaysian e-cigarette industry will continue to grow as the number of industry players increases.
