2. Application basis

1. The Implementation Regulations of the People's Republic of China The Implementation Regulations of the Monopoly Law of the People's Republic of China shall be implemented by the relevant provisions of the new type of tobacco products such as electronic cigarettes.

2. Article 5 of the "Administrative Measures for Electronic Cigarettes" shall meet the mandatory national standards of electronic cigarettes. Article 7 The State Council tobacco monopoly administrative department shall organize professional institutions to conduct technical review of electronic cigarette products based on application materials such as inspection and testing reports. Article 19 The electronic cigarette products that have not passed the technical review shall not be listed and sold. 5. Application conditions

(1) Applicant conditions

1. Have the qualifications of corporate legal person;

2. The trademark right of the electronic cigarette product for the electronic cigarette;

3. Comply with the requirements of the national electronic cigarette industry policy;

4. Other conditions stipulated by the State Council tobacco monopoly administrative department.

If the trademark owner is an overseas enterprise, it shall entrust the institution or agent established in the country to apply to the provincial tobacco monopoly administrative department.

For applications for overseas trademark owners, it shall meet the conditions of the first, 3 and 4 of the previous paragraph.

1. Comply with electronic cigarette compulsory national standards;

2. Use a trademark approved in China;

3. Comply with the relevant provisions of the packaging logo and warning of electronic cigarette products;

4. Other conditions stipulated by the State Council tobacco monopoly administrative department.

Electronic cigarette products sold in a packaging unit, their inner smoke bombs and supporting smoke utensils should be products that have passed technical review.

6. Application information

(1) Selling electronic cigarette products in the country

Applying for domestic sales of electronic cigarette product technology review shall submit the following information through the management system:

1. Basic information of the product;

2. The trademark registration certificate of the product;

3. Product packaging and appearance pictures;

4. Sample manuscripts in the product;

5. Product description report;

6. Product formula and raw materials report;

7. Key production process description related to safety;

8. Product inspection test report and other necessary inspection and test reports;

9. Product safety assessment or demonstration report;

10. The applicant's commitment to submit the legitimacy, authenticity, and integrity of the materials;

11. Other related information.

The electronic cigarette products sold in a packaging unit must have passed the technical review of smoke bombs and supporting smoke utensils, and only need to be submitted to the first to 4 materials specified in the preceding paragraph.

In addition to the information stipulated in the preceding paragraph, imported electronic cigarette products also need to provide certification materials for the obtained production or sales of the country (region).

After receiving the application, the provincial -level tobacco monopoly administrative department organized the online review of the information. For those who meet the requirements, the paper with paper information and physical sample mailing notifications; if the information needs to be corrected, inform the applicant's all content that needs to be corrected.

After receiving the mailing notice, the applicant shall submit a technical review paper data and physical samples to the provincial tobacco monopoly administrative department as consistent with the application information. If the technical review agency is responsible for the formal review of the application materials, if it needs to be corrected, the applicant is notified of the content that needs to be corrected, and the applicant will supplement the improvement of the materials by mail.

(2) Supplementary instructions

1. Product technology review applications have two entrances: "New Products" and "New Existing Series". The series of products refers to the same type of product with different products and packaging appearance, or the number of products in the box, and the remaining characteristic parameters are completely consistent. When applying for a new application, you only need to submit the application materials of any product in the same series of products through the "New Product" entrance. 13. Forbidden sexual requirements
