Philippines FDA wants to regulate e-cigarettes by itself: a health product, not a consumer product

The Philippine FDA stated that the regulation of e-cigarettes, vaping devices and other heated tobacco products (HTP) must be the responsibility of the Food and Drug Administration (FDA) and must not be transferred to the Philippine Department of Trade and Industry (DTI) because these products involve public health.


The FDA made its position clear in a statement it issued in support of the Department of Health (DOH) requesting the President to veto the e-cigarette bills (Senate Bill 2239 and House Bill 9007), which shift regulatory jurisdiction grounds.


"The DOH, through the FDA, assumes the constitutional mandate to protect every Filipino's right to health by establishing an effective regulatory system," the FDA statement read.


Contrary to the proposed measure, the FDA said vaping products and HTPs must be considered health products, not consumer products.


“This is especially because the industry is marketing such products as alternatives to traditional cigarettes, with some even claiming or implying that these products are safer or less harmful,” the FDA said.
