March 30, 2013 - The Canadian Vaping Association (CVA) is praising police departments in Saanich and Calgary for their recent investigations into businesses and individuals selling nicotine vaping products to minors, it was reported.
Calgary's Gemini Convenience Store was fined $10,000 for selling e-cigarette products to minors and failing to verify the age of customers under 25, violating the Tobacco, Smoking and E-Cigarette Reduction Act.
In addition, Saanich police uncovered an operation targeting teenagers that arranged the sale of nicotine and marijuana products in middle and high schools through the social media platform Snapchat. More than $100,000 worth of products have been seized but no charges have been filed. Saanich police are working with federal agencies to determine if any laws were broken.
The CVA wants to bring charges under the federal Tobacco and Vaping Products Act (TVPA) and the Cannabis Act.
"Canada has strong regulations in place to prevent youth access to vaping products and to protect youth from the lure of e-cigarettes. These regulations have proven effective in combating youth experimentation, but there is no regulation that can combat individuals willing to break the law."
We want increased resources for law enforcement and are pleased that local police departments are taking action to protect young people, said Darryl Tempest, government relations adviser for the Vape Association of Canada Appeal CVA.
At present, the penalties for underage sales are too lenient to act as an effective deterrent. While the initial transgressions deserve some leniency, repeated sales to minors can result in harsher fines and penalties.
For those willing to break the law, small fines become the cost of doing business, and the consequences are seen as benign. Local authorities should consider revoking the designated licences of commercial and professional vape shops for repeat offenders and serious offences.
Although some health groups have called for stricter regulation of e-cigarettes, regulation does not prevent crime. The survey found that young people most often obtained vaping products through social channels. The solution to preventing youth from illegally obtaining vaping products is not more regulation, but more enforcement and resources dedicated to enforcement efforts.
