The judge reduces the concession fee in Vuse Alto electronic cigarette litigation

New Consumer Report, January 31st, according to LAW360 report, a US Federal Judge in North Carolina reduced RJ Reynolds Vapor Co. The continuous patent rate paid by the Asian Customer Service Department.


In September 2022, the District Court of North Carolina, the Central District of North Carolina, ruled that the Vuse Alto E-Vapor product of Reynolds Vapor Co. infringed up the three patents of Opi Asia, and served Ochgia customers more than $ 95 million.


In his opinion on January 27, the US judge N. Carlton Tilley Jr. ruled that it was reasonable to continue to charge Vuse Alto, but it was not twice the decision of the jury.


The opinion of the continuous permission rate required by Opi Asia was reduced from 10.5% to 5.25%. Reynolds had to pay once a quarter until Ochiya's last patent expired on April 22, 2035.


"Since May 2019, Opiia has not proved the contribution of electronic cigarette patents to Alto's performance. There are reasons to increase the patent rate of the jury by 5.25%." Judge Tili wrote.


Earlier this month, Judge Tili rejected Renault's new trial in the Vuse Alto dispute.


Reynolds Vapor Co. has requested new trials, saying that Opi Asia has inappropriately injected the incarient evidence of patent infringement allegations against REynolds in other cases, making Reynolds unable to obtain fair trials.
